I am organizing an occasion that will solicit donations to a college scholarship plan. The plan has existed for 40 years. We had been taking into consideration performing a ‘retrospective’ CD of songs representing the past 40 many years and giving it away to donors at or above a specified degree. You need to write a letter to the copyright holder of the song and ask for thier permission to use it
well if you bought the songs yes, it is legal. but if the songs are torrents…you probably shouldn’t give it away.
If you do not own the copyright to the music you are giving away, then it is considered piracy. This is what got Napster shut down when they were a free service.
You would have to ask ASCAP or BMI for permission and pay a fee. Anything else is copyright infrigement.

No one seems to get this simple fact, infringement is RAMPANT, yet everyone whines about the RIAA being “greedy.”

The only way to make it legal is to contact the artists or labels that carry the artists who’s music you are putting on the CD, and obtain their permission to use the song on the CD.
MANY (though certainly not all) will agree to allow a song of theirs to be used for free or a small fee (though some company’s idea of small differs from others) as long as the number of CDs is limited to a predetermined number.
In all honesty….the hard part is getting ahold of the right people to obtain that permission. That can take weeks or even months for a person who doesn’t already have the contacts established to accomplish. Believe me….I’ve tried to obtain permission rights for using music in a video I wanted to submit to sundance. NOT EASY.
By copying them, you have already violated the Copyright laws. Dispensing them (free or otherwise) is still illegal.
